{"id":2036,"date":"2025-02-17T14:27:46","date_gmt":"2025-02-17T13:27:46","guid":{"rendered":"https:\/\/www.manutan.sk\/magazin\/?p=2036"},"modified":"2025-09-11T12:24:20","modified_gmt":"2025-09-11T10:24:20","slug":"ake-su-povinnosti-zamestnavatela-pri-pracovnom-uraze","status":"publish","type":"post","link":"https:\/\/www.manutan.sk\/magazin\/?p=2036","title":{"rendered":"Ak\u00e9 s\u00fa povinnosti zamestn\u00e1vate\u013ea pri pracovnom \u00faraze?"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">\u010co je pracovn\u00fd \u00faraz<\/h2>\n\n\n\n<p>Pracovn\u00fd \u00faraz presnej\u0161ie vymedzuje Z\u00e1konn\u00edk pr\u00e1ce (<span class=\"has-inline-color has-primary-color\"><a href=\"https:\/\/www.slov-lex.sk\/ezbierky\/pravne-predpisy\/SK\/ZZ\/2001\/311\/20221201\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 195 ods. 2, \u010d.&nbsp;311\/2001 Z. z<\/a><\/span><a href=\"https:\/\/www.slov-lex.sk\/ezbierky\/pravne-predpisy\/SK\/ZZ\/2001\/311\/20221201\">.<\/a>).<\/p>\n\n\n\n<p>Pod\u013ea neho sa pracovn\u00fdm \u00farazom rozumie po\u0161kodenie zdravia alebo smr\u0165 zamestnanca, ak k&nbsp;nim do\u0161lo nez\u00e1visle od jeho v\u00f4le <strong>kr\u00e1tkodob\u00fdm, n\u00e1hlym a&nbsp;n\u00e1siln\u00fdm<\/strong> p\u00f4soben\u00edm vonkaj\u0161\u00edch vplyvov <strong>pri plnen\u00ed pracovnej \u00falohy<\/strong> <strong>a v&nbsp;priamej s\u00favislosti s&nbsp;\u0148ou.<\/strong><br><br>Ako pracovn\u00fd \u00faraz sa posudzuje aj \u00faraz, ktor\u00fd zamestnanec utrpel kv\u00f4li plneniu pracovn\u00fdch \u00faloh. Medzi pracovn\u00e9 \u00farazy sa m\u00f4\u017ee po\u010d\u00edta\u0165 aj <strong>\u201enevidite\u013en\u00e1\u201c psychick\u00e1 ujma.<\/strong><\/p>\n\n\n\n<p><br><strong>Pr\u00edklady pracovn\u00fdch \u00farazov:<\/strong>&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Recep\u010dn\u00e1 sa v&nbsp;pr\u00e1ci obar\u00ed vodou z&nbsp;k\u00e1vovaru.<\/li><li>Zamestnanec sa pore\u017ee no\u017eom vo firemnej kuchynke.<\/li><li>Pr\u00e1vnik je fyzicky napadnut\u00fd svoj\u00edm klientom.<\/li><li>Po\u010das slu\u017eobnej cesty je zamestnanec \u00fa\u010dastn\u00edkom autonehody, pri ktorej zomrie jeho kolega. Z\u00e1\u017eitok n\u00edm \u0165a\u017eko psychicky otrasie.<\/li><\/ul>\n\n\n\n<p>V\u0161etky uveden\u00e9 pr\u00edklady sp\u013a\u0148aj\u00fa krit\u00e9ri\u00e1 stanoven\u00e9 z\u00e1konom \u2013 od kr\u00e1tkodob\u00e9ho a&nbsp;n\u00e1hleho p\u00f4sobenia javu a\u017e po&nbsp;plnenie pracovnej \u00falohy \u010di&nbsp;s\u00favislosti s&nbsp;\u0148ou.<\/p>\n\n\n\n<p>V pr\u00edpade, \u017ee sa teda niektor\u00fd zo zamestnancov zran\u00ed po\u010das \u010dinnosti, ktor\u00e1 vybo\u010duje z&nbsp;plnenia pracovn\u00fdch \u00faloh, nemus\u00ed to by\u0165 ako pracovn\u00fd \u00faraz uznan\u00e9. Napr\u00edklad ak by sa dvaja skladn\u00edci zab\u00e1vali po\u010das zmeny h\u00e1dzan\u00edm predmetov a&nbsp;jeden z&nbsp;nich by sa pri tom zranil, o&nbsp;pracovn\u00fd \u00faraz by ne\u0161lo \u2013 neplnili svoju pracovn\u00fa povinnos\u0165.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u010co nie je pracovn\u00fd \u00faraz<\/h2>\n\n\n\n<p>Naopak, o&nbsp;pracovn\u00fd \u00faraz <strong>nejde<\/strong>, ak sa zamestnancovi <strong>stal pri ceste do zamestnania a&nbsp;sp\u00e4\u0165.<\/strong><\/p>\n\n\n\n<p><strong>Pr\u00edklady, kedy nejde o&nbsp;pracovn\u00fd \u00faraz:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Zamestnanec ide na obed (ak jed\u00e1le\u0148 nie je s\u00fa\u010das\u0165ou are\u00e1lu zamestn\u00e1vate\u013ea) \u010di&nbsp;k&nbsp;lek\u00e1rovi, po&nbsp;ceste zakopne a&nbsp;zlom\u00ed si nohu.<\/li><li>Zamestnanec sa zran\u00ed cestou k&nbsp;lek\u00e1rovi, ktor\u00fd s\u00eddli mimo objektu zamestn\u00e1vate\u013ea.<\/li><\/ul>\n\n\n\n<p><strong>Ak\u00e9 druhy pracovn\u00fdch \u00farazov rozli\u0161ujeme?&nbsp;<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Smrte\u013en\u00fd \u00faraz<\/strong> \u2013 po\u0161kodenie zdravia, ktor\u00e9ho n\u00e1sledkom najnesk\u00f4r do 1 roka zamestnanec zomrie.<\/li><li><strong>Z\u00e1va\u017en\u00fd<\/strong> <strong>\u00faraz<\/strong> \u2013 po\u0161kodenie zdravia, ktor\u00e9ho n\u00e1sledkom je zamestnanec hospitalizovan\u00fd viac ako 5&nbsp;dn\u00ed.<\/li><li><strong>Ostatn\u00e9 \u00farazy <\/strong>\u2013 po\u0161kodenie zdravia, ktor\u00e9ho n\u00e1sledkom do\u0161lo k&nbsp;zraneniu zamestnanca s&nbsp;pracovnou neschopnos\u0165ou dlh\u0161ou ako 3 kalend\u00e1rne dni.<\/li><\/ol>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"687\" src=\"https:\/\/www.manutan.sk\/magazin\/wp-content\/uploads\/2022\/12\/lidenalodi-1024x687.jpg\" alt=\"Parta lid\u00ed na kanoi\" class=\"wp-image-3825\" srcset=\"https:\/\/www.manutan.sk\/magazin\/wp-content\/uploads\/2022\/12\/lidenalodi-1024x687.jpg 1024w, https:\/\/www.manutan.sk\/magazin\/wp-content\/uploads\/2022\/12\/lidenalodi-300x201.jpg 300w, https:\/\/www.manutan.sk\/magazin\/wp-content\/uploads\/2022\/12\/lidenalodi-768x515.jpg 768w, https:\/\/www.manutan.sk\/magazin\/wp-content\/uploads\/2022\/12\/lidenalodi-1536x1030.jpg 1536w, https:\/\/www.manutan.sk\/magazin\/wp-content\/uploads\/2022\/12\/lidenalodi.jpg 1999w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><figcaption><em>Pracovn\u00fdm \u00farazom m\u00f4\u017ee by\u0165 dokonca aj zranenie pracovn\u00edka po\u010das teambuildingu \u2013 ak sa stal v&nbsp;r\u00e1mci programu organizovan\u00e9ho zamestn\u00e1vate\u013eom.<\/em><\/figcaption><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">N\u00e1vod, ako postupova\u0165 pri pracovnom \u00faraze<\/h2>\n\n\n\n<p>Povinnosti zamestn\u00e1vate\u013ea pri pracovnom \u00faraze stanovuje op\u00e4\u0165 Z\u00e1konn\u00edk pr\u00e1ce (<span class=\"has-inline-color has-primary-color\"><a href=\"https:\/\/www.slov-lex.sk\/ezbierky\/pravne-predpisy\/SK\/ZZ\/2001\/311\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 196 z\u00e1kona \u010d.&nbsp;311\/2001 Z. z.<\/a><\/span>). Ako presne pracovn\u00fd \u00faraz evidova\u0165 a&nbsp;kam ho hl\u00e1si\u0165, n\u00e1jdete v&nbsp;<span class=\"has-inline-color has-primary-color\"><a href=\"https:\/\/www.epi.sk\/zz\/2006-346\" target=\"_blank\" rel=\"noreferrer noopener\">Nariadeniach vl\u00e1dy SR \u010d.&nbsp;346\/2006 Z. z<\/a><\/span>.<\/p>\n\n\n\n<p>Nech sa vo firme stane akoko\u013evek mal\u00fd \u00faraz, postupy dodr\u017ete, vr\u00e1tane evidencie. Vyplat\u00ed sa v\u00e1m to najm\u00e4 v&nbsp;situ\u00e1cii, ke\u010f budete u&nbsp;pois\u0165ovne uplat\u0148ova\u0165 n\u00e1hradu \u0161kody alebo majetkov\u00fa ujmu, ktor\u00e1 v&nbsp;s\u00favislosti s&nbsp;\u00farazom vznikla.<\/p>\n\n\n\n<p>V praxi navy\u0161e ob\u010das vznikaj\u00fa spory oh\u013eadom toho, \u010di&nbsp;sa skuto\u010dne jednalo o&nbsp;pracovn\u00fd \u00faraz. Z\u00e1kon ur\u010duje, \u017ee <strong>je to pr\u00e1ve zamestn\u00e1vate\u013e, kto stanov\u00ed, \u010di&nbsp;ide o&nbsp;pracovn\u00fd \u00faraz.<\/strong> Ak zamestn\u00e1vate\u013e odmieta, \u017ee ide o&nbsp;pracovn\u00fd \u00faraz, m\u00f4\u017ee sa po\u0161koden\u00fd pracovn\u00edk obr\u00e1ti\u0165 na s\u00fad \u2013 aj z&nbsp;tohto d\u00f4vodu majte dokument\u00e1ciu v\u017edy v&nbsp;poriadku.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ako postupova\u0165 pri pracovnom \u00faraze krok za krokom:<\/h2>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Zabezpe\u010di\u0165 miesto \u00farazu a&nbsp;jeho okolie <\/strong>(napr. zastavi\u0165 stroj, odpoji\u0165 energovody), pr\u00edpadne poskytn\u00fa\u0165 prv\u00fa pomoc.<\/li><li><strong>Zisti\u0165 pr\u00ed\u010dinu a&nbsp;okolnosti vzniku tohto \u00farazu<\/strong> za \u00fa\u010dasti zamestnanca (ak to zdravotn\u00fd stav zamestnanca dovo\u013euje) a&nbsp;pr\u00edslu\u0161n\u00e9ho z\u00e1stupcu zamestnancov pre bezpe\u010dnos\u0165.<\/li><li><strong>Zap\u00edsa\u0165 \u00faraz do elektronickej \u010di&nbsp;papierovej knihy \u00farazov<\/strong> (aj v&nbsp;pr\u00edpade, \u017ee zamestnanec nie je pr\u00e1ceneschopn\u00fd).<\/li><li><strong>Ozn\u00e1mi\u0165 vznik z\u00e1va\u017en\u00e9ho pracovn\u00e9ho \u00farazu<\/strong> bez zbyto\u010dn\u00e9ho odkladu pr\u00edslu\u0161n\u00e9mu in\u0161pektor\u00e1tu pr\u00e1ce alebo pr\u00edslu\u0161n\u00e9mu org\u00e1nu dozoru a&nbsp;v&nbsp;pr\u00edpade podozrenia, \u017ee v&nbsp;s\u00favislosti s&nbsp;pracovn\u00fdm \u00farazom bol sp\u00e1chan\u00fd trestn\u00fd \u010din, tak aj pr\u00edslu\u0161n\u00e9mu \u00fatvaru Policajn\u00e9ho zboru.<\/li><li><strong>Sp\u00edsa\u0165 z\u00e1znam o&nbsp;registrovanom pracovnom \u00faraze<\/strong> najnesk\u00f4r do \u0161tyroch dn\u00ed po&nbsp;ozn\u00e1men\u00ed vzniku registrovan\u00e9ho pracovn\u00e9ho \u00farazu.<\/li><li>Zasla\u0165 pr\u00edslu\u0161n\u00e9mu in\u0161pektor\u00e1tu pr\u00e1ce<strong> z\u00e1znam o&nbsp;registrovanom pracovnom \u00faraze do \u00f4smich dn\u00ed odo d\u0148a<\/strong>, kedy ste sa o&nbsp;tomto pracovnom \u00faraze dozvedeli.<\/li><li><strong>Prija\u0165 a&nbsp;vykona\u0165 potrebn\u00e9 opatrenia<\/strong>, aby sa zabr\u00e1nilo opakovaniu podobn\u00e9ho pracovn\u00e9ho \u00farazu.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">Ako vy\u0161etri\u0165 okolnosti vzniku \u00farazu<\/h2>\n\n\n\n<p>Va\u0161ou z\u00e1kladnou povinnos\u0165ou je objasnenie pr\u00ed\u010din a&nbsp;okolnost\u00ed pracovn\u00e9ho \u00farazu. To prebieha za \u00fa\u010dasti:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>zranen\u00e9ho zamestnanca, ak to jeho zdravotn\u00fd stav dovo\u013euje,<\/li><li>ostatn\u00fdch zamestnancov a&nbsp;svedkov, ktor\u00ed boli v&nbsp;\u010dase udalosti pr\u00edtomn\u00ed,<\/li><li>pr\u00edslu\u0161n\u00e9ho z\u00e1stupcu zamestnancov pre bezpe\u010dnos\u0165,<\/li><li>v pr\u00edpade z\u00e1va\u017en\u00e9ho pracovn\u00e9ho \u00farazu aj autorizovan\u00e9ho bezpe\u010dnostn\u00e9ho technika.<\/li><\/ul>\n\n\n\n<p>Zamestn\u00e1vate\u013e <strong>nesmie bez v\u00e1\u017enych d\u00f4vodov meni\u0165 stav pracoviska na mieste \u00farazu,<\/strong> k\u00fdm nebud\u00fa objasnen\u00e9 pr\u00ed\u010diny a&nbsp;okolnosti vzniku pracovn\u00e9ho \u00farazu.<\/p>\n\n\n\n<p><span class=\"has-inline-color has-primary-color\"><a href=\"https:\/\/www.manutan.sk\/magazin\/https-www-manutan-sk-magazin-wp-content-uploads-2024-02-2023_09_checklist_jak_vybavit_lekarnicku_sk_preklad-pdf\/\" target=\"_blank\" rel=\"noreferrer noopener\">Viete, \u010do&nbsp;patr\u00ed do lek\u00e1rni\u010dky na pracovisku a&nbsp;ako ju spr\u00e1vne ozna\u010di\u0165?<\/a><\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Z\u00e1pis do knihy \u00farazov<\/h2>\n\n\n\n<p>Zamestn\u00e1vate\u013e mus\u00ed z\u00e1rove\u0148 vies\u0165 evidenciu v\u0161etk\u00fdch pracovn\u00fdch \u00farazov, v&nbsp;ktorej uvedie \u00fadaje potrebn\u00e9 na sp\u00edsanie z\u00e1znamu o&nbsp;registrovanom pracovnom \u00faraze, ak sa n\u00e1sledky pracovn\u00e9ho \u00farazu prejavia nesk\u00f4r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Z\u00e1znam o&nbsp;pracovnom \u00faraze<\/h2>\n\n\n\n<p>Ak sa pracovn\u00edk zran\u00ed tak, \u017ee bude pr\u00e1ceneschopn\u00fd viac ako 3 dni (\u010di&nbsp;dokonca zomrie), mus\u00edte okrem zaevidovania \u00farazu do knihy sp\u00edsa\u0165 tzv.<a href=\"https:\/\/www.slov-lex.sk\/ezbierky\/pravne-predpisy\/SK\/ZZ\/2006\/500\/\"> <\/a><span class=\"has-inline-color has-primary-color\"><a href=\"https:\/\/www.slov-lex.sk\/ezbierky\/pravne-predpisy\/SK\/ZZ\/2006\/500\/\" target=\"_blank\" rel=\"noreferrer noopener\">z\u00e1znam o&nbsp;registrovanom pracovnom \u00faraze<\/a><\/span>. Je to ofici\u00e1lny formul\u00e1r, ktor\u00fd potom za\u0161lete pr\u00edslu\u0161n\u00e9mu in\u0161pektor\u00e1tu pr\u00e1ce alebo pr\u00edslu\u0161n\u00e9mu org\u00e1nu dozoru. Z\u00e1rove\u0148 ho doru\u010d\u00edte aj zamestnancovi, ktor\u00fd utrpel registrovan\u00fd pracovn\u00fd \u00faraz, alebo pozostal\u00fdm, ak zamestnanec zomrel v&nbsp;d\u00f4sledku pracovn\u00e9ho \u00farazu.<br><br><strong><span class=\"has-inline-color has-primary-color\">TIP:<\/span> <\/strong>Formul\u00e1r z\u00e1znamu o&nbsp;\u00faraze si m\u00f4\u017eete stiahnu\u0165 napr\u00edklad na <span class=\"has-inline-color has-primary-color\"><a href=\"https:\/\/www.employment.gov.sk\/files\/formulare-praca\/22452_subor.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">webovej str\u00e1nke MPSVR<\/a><\/span>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Od\u0161kodnenie pracovn\u00e9ho \u00farazu<\/h2>\n\n\n\n<p>Od\u0161kodnenie zamestnanec spravidla obdr\u017e\u00ed potom, \u010do&nbsp;si nech\u00e1 od o\u0161etruj\u00faceho lek\u00e1ra vyplni\u0165 formul\u00e1r pr\u00edslu\u0161nej zdravotnej pois\u0165ovne. Ten za\u0161le do pois\u0165ovne spolu so zdravotnou dokument\u00e1ciou a&nbsp;ona od\u0161kodnenie vyhodnot\u00ed.<\/p>\n\n\n\n<p>Zamestnanec m\u00e1 n\u00e1rok na n\u00e1hradu za boles\u0165 (tzv.&nbsp;bolestn\u00e9) a&nbsp;s\u0165a\u017eenie spolo\u010densk\u00e9ho uplatnenia. Ak v&nbsp;d\u00f4sledku \u00farazu d\u00f4jde k&nbsp;zn\u00ed\u017eeniu pr\u00edjmu, m\u00f4\u017ee zamestnanec po\u017eadova\u0165 aj n\u00e1hradu za stratu na z\u00e1robku.<\/p>\n\n\n\n<p>\u010ealej m\u00e1 pr\u00e1vo na \u00fahradu \u00fa\u010delne vynalo\u017een\u00fdch n\u00e1kladov spojen\u00fdch s&nbsp;lie\u010den\u00edm, ako s\u00fa v\u00fddavky na lieky, zdravotn\u00edcke pom\u00f4cky \u010di&nbsp;rehabilit\u00e1cie. V&nbsp;pr\u00edpade obzvl\u00e1\u0161\u0165 z\u00e1va\u017en\u00e9ho po\u0161kodenia zdravia m\u00f4\u017eu by\u0165 od\u0161kodnen\u00ed aj bl\u00edzki pr\u00edbuzn\u00ed zamestnanca.<\/p>\n\n\n\n<p>Na od\u0161kodnenie <strong>maj\u00fa pr\u00e1vo v\u0161etci zamestnanci<\/strong> \u2013 vr\u00e1tane t\u00fdch zamestnan\u00fdch na DP\u010c \u010di&nbsp;DPP.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Nepodce\u0148te prevenciu<\/h2>\n\n\n\n<p>Lektorka BOZP Lucie Piln\u00e1\u010dkov\u00e1 uv\u00e1dza, \u017ee za pracovn\u00fdmi \u00farazmi stoj\u00ed \u010dasto podcenenie prevencie a&nbsp;obch\u00e1dzanie pracovn\u00fdch predpisov. Preto zd\u00f4raz\u0148uje, aby ved\u00faci pracovn\u00edci komunikovali so zamestnancami. A&nbsp;to nielen o&nbsp;tom, \u010di&nbsp;dodr\u017eiavaj\u00fa alebo nedodr\u017eiavaj\u00fa predp\u00edsan\u00e9 postupy, ale aj o&nbsp;tom, \u010do&nbsp;im napr\u00edklad s\u0165a\u017euje podmienky a&nbsp;pre\u010do nie\u010do obch\u00e1dzaj\u00fa.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u201ePri vy\u0161etrovan\u00ed okolnost\u00ed \u00farazu sa pracovn\u00edci in\u0161pektor\u00e1tu pr\u00e1ce v\u00e4\u010d\u0161inou dostan\u00fa aj k&nbsp;t\u00e9me kontrol na pracovisku. A&nbsp;pr\u00e1ve tam b\u00fdva pes zakopan\u00fd. \u010casto nar\u00e1\u017eame na tzv.&nbsp;trpen\u00fd sp\u00f4sob \u2013 znamen\u00e1 to, \u017ee pracovn\u00edk nedodr\u017eiava pravidl\u00e1 (napr. nenos\u00ed ochrann\u00e9 pom\u00f4cky) a&nbsp;jeho nadriaden\u00fd na to nereaguje, aj ke\u010f o&nbsp;tom vie.
